ICO Launches Free Data Protection Training for UK SMEs as Regulatory Expectations Rise

ICO · 2026-08-12

The Information Commissioner’s Office has launched new, free online data protection training aimed specifically at small and medium-sized organisations and sole traders across the UK, the regulator announced on 11 August. The training, framed as helping businesses “boost their business fitness,” covers core data protection obligations under UK GDPR. While the ICO has long provided guidance for large organisations, the explicit focus on SMEs signals that the regulator expects data protection compliance to be universal — not something only enterprises with dedicated legal teams can manage. For recruitment agencies, staffing firms, and SME employers who handle candidate and employee data daily, the training represents both a resource and a warning: the ICO is making it easier to comply, which makes ignorance harder to excuse.

For TA leaders at SMEs and recruitment agencies, this matters in two directions. First, as employers: if your hiring process collects, stores, or processes candidate data — and every ATS does — the ICO expects you to know your obligations, full stop. Second, as buyers of recruitment technology: when you evaluate an ATS or AI screening tool, you are ultimately responsible for how that vendor handles data on your behalf. The ICO’s training offer removes the ‘we didn’t know’ defence. If your recruitment stack includes AI-powered tools that process candidate data, the training is not optional reading — it’s the baseline your regulator expects you to have covered before you even switch the tool on.

All action is situated in your corporate context. These are starting points, not prescriptions — choose what fits.

Who to talk with in your enterprise

Your Data Protection Officer or compliance lead: forward the ICO training link and ask them to identify which modules are most relevant to your recruitment data flows — candidate sourcing, CV parsing, interview recording, and onboarding data collection. Your HRIS or ATS administrator: when was the last time you reviewed your candidate data retention schedules against ICO guidance?

What to take a closer look at

Audit your candidate data retention policy. How long do you keep rejected applicants’ CVs and interview notes? If the answer is ‘indefinitely’ or ‘we don’t have a policy,’ that’s a compliance gap the ICO’s training explicitly addresses. Check whether your ATS has automated data retention rules configured — most do, but very few are switched on.

What to think about more deeply

The ICO is offering free training because it knows most SMEs won’t pay for it. But if the training is free and you still haven’t done it, what does that say about how seriously your organisation takes candidate data — and what would a regulator conclude?
